The saying stretches as far back as the 1700s, when port cities like New York and New Haven had laws to ban oyster harvesting during the summer, says Rowan Jacobsen, author of "A Geography of Oysters." The law helped oyster stocks replenish during summer spawning season, he writes, but it also adhered to common sense. Before we had refrigeration, people were protected from getting food poisoning from oysters that had been sitting in barrels on a hot day.
